The Residential Real Estate Rule requires certain real estate professionals involved in the settlement or closing process to submit a report to FinCEN regarding certain transfers of residential real estate that are a high-risk for illicit finance--namely, residential real estate transferred to a legal entity or trust without financing from a bank or similar financial institution. Reporting persons must submit a Real Estate Report for reportable transfers occurring on or after March 1, 2026. The information collected from residential real estate reporting will help combat money laundering and safeguard housing affordability by increasing transparency in the U.S. residential real estate sector. FinCEN will provide an overview of the new rule--including the circumstances in which a report must be filed, who must file a report, what information must be provided, and when a report is due--as well as answer audience questions.
